Train accidents can involve numerous factors and range in severity. Sometimes, the accident involves only one train and injures passengers on board or people surrounding the train. In other crashes, multiple vehicles are involved in addition to the train passengers, rail cars tumble onto roadways, or cars spill hazardous materials near neighborhoods.

In any instance, due to the sheer size of the train cars, the injuries to those on board or otherwise involved can be severe or even fatal.

The most common types of train accidents include:

  • Collisions between trains
  • Collisions between trains and other vehicles at crossings
  • Trains striking pedestrians at crossings or along rail tracks
  • Derailments, which can also involve accidents with other vehicles and/or spills.

Serious Accidents with Serious Injuries

Because of the scale of train accidents, they can easily lead to extremely serious injuries, or even prove fatal. Broken bones, dislocated joints, injury to internal organs or internal bleeding, head and brain trauma, spinal cord injury and paralysis are not uncommon in these situations.

Depending on the circumstances of the crash, significant burn injuries can also occur.

While all these injuries can range in severity, one common factor that train accident victims experience is overwhelming medical bills that threaten to consume their financial future. That’s where we come in.

Legal Time Deadlines You Should Know

It’s important to recognize that after a train crash injury, the clock starts ticking on the amount of time you have to file a claim. This is known as the “statute of limitations” and varies widely depending on the circumstances of the case and the state laws that apply. Additionally, these time deadlines can vary based on several other factors that can shorten or lengthen the amount of time you have to bring a claim.

For example, claims against governmental entities, can have much shorter deadlines. In some cases, a combination of different types of legal claims may exist that involve different time frames, which may be due to multiple defendants and/or even the laws of more than one jurisdiction.

In train collisions involving automobiles, many insurance policies owned by the victim or the victim’s family, also have timely notification requirements, where if a claim is not filed in time or appropriate notice is not given, the family of the decedent can lose valuable insurance, such as Uninsured/Underinsured Motorist coverage.

In addition to the above legal and contractual deadlines, there are other reasons to act without delay: important evidence necessary for a case can disappear or become destroyed, and witnesses can go missing or forget what happened. Our attorneys act appropriately to preserve important evidence.

Our train accident attorneys can examine the facts and circumstances relevant to your case to determine which statutes of limitations (deadlines) apply. We take the required actions to preserve all-important legal deadlines on behalf of our clients, and when appropriate, make sure important evidence is preserved.

You Are Not Alone

People tend to view train accidents as rare, isolated incidents, but they are actually more common than you might think. According to the Federal Railroad Administration (FRA), there were 10,495 accidents or incidents involving trains in the United States in 2019. From these, 881 people were killed. The FRA indicates that derailments led to 1,185 train accidents in 2019, human factors led to 679 accidents, track causes led to 448 accidents, equipment causes led to 236 accidents, and collisions led to 101 accidents.

In 2018, a total of 2,217 accidents occurred in the U.S. involving vehicles and trains, and these accidents resulted in 840 injuries and 262 fatalities. The fatalities usually involve people who are not railroad employees, meaning passengers, motorists, or pedestrians. Crashes between trains and motor vehicles are 20 times more likely to kill motorists than crashes between multiple motor vehicles.

On top of all the injustices your train accident has caused, you shouldn’t have to contend with bills for someone else’s recklessness. There are enough troubles on your mind; let Montlick navigate the legal matrix, so you can focus on moving forward.

What should I do after a train accident?
First, always seek immediate medical attention. Make sure to tell the provider all symptoms or injuries, even if they seem minor in the moment. Often, injuries will worsen over time.

What are common causes of train accidents?
Trains are not able to quickly come to a stop the way that cars can. They need a considerably greater distance and more notice in order to come to a stop. They also cannot make evasive maneuvers in the way cars can. Any issues that arise during a train’s route, therefore, can result major accidents.

Who is responsible in a train and car collision?
The cause or causes of a train accident can dictate the people or entities to be named in a potential lawsuit. Railroad companies, private corporations, and municipalities have a duty to maintain railroad crossings in order to keep drivers safe from collision.
